Information on the processing of personal data addressed to customers and prospects

This information has been prepared pursuant to articles 13 and 14 of EU Regulation 2016/679 of the European Parliament and of the Council, concerning the protection of individuals with regard to the processing of personal data, as well as the free movement of such data and repealing Directive 95/46 EC (General Data Protection Regulation).

This information is provided exclusively for the Safety-Fire website and not for other websites that may be accessible by the User via links.
This privacy statement is intended to describe the methods followed by the Data Controller in the collection and processing of your personal data after your access to our website or our services, as well as any data provided by you through the website when subscribing to our newsletter, when purchasing goods or services.

Personal data processed and their source

The personal data being processed are related to:

  • Identity Data includes, for example: name, surname, titles, name or company name, customer code or similar identifiers.

We also collect, use and share Aggregated Data, including statistical and demographic data, for any purpose. Although Aggregated Data may be derived from your personal data, it is not considered personal data by law, as it does not reveal your identity either directly or indirectly. For example, we may aggregate your Usage Data to calculate the percentage of users accessing specific content on our website. However, if we associate or link Aggregated Data to your personal data in a way that would make you directly or indirectly identifiable, we will treat this set of data as personal data, therefore in accordance with this privacy policy.
Safety-Fire does not collect Special Categories of Personal Data (such as data on race, ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, trade union membership, information about your health conditions and genetic and biometric data).

These data are provided by you directly, also by filling in online forms, or can be collected from independent third party data controllers (eg agents, distributors, brokers, commercial information companies, registers, lists or databases accessible to the public, etc.).

If you do not provide your personal data

If it is necessary to collect personal data by law or contractual obligations and you do not provide such data at the time of the request, we may not be able to perform the performance provided for in the contract in question (for example, the provision of goods or services). In this case, we may be forced to cancel your order for a service and, if this happens, we will promptly notify you.

Purpose of the processing

The processing is carried out for the following purposes:

  1. execution of contracts and related legal obligations;
  2. protection of rights arising from the contract;
  3. recovery or assignment of the claim;
  4. organizational and commercial management of the contract and after-sales activities (for example, relations with agents, distributors, service center contractors);
  5. solvency disclosure and risk protection activities;
  6. internal statistical analysis;
  7. education and training activities on the use of products/services;
  8. marketing activities through the sending of promotional and advertising material concerning products / services similar to those covered by the existing commercial relationship;
  9. invitations to conferences, events, initiatives promoted by the writer or whose object is related to the existing business relationship;
  10. control and management of the correct functioning of our website.

Legal basis of the processing

The provision of data is mandatory for the purposes indicated in points from l to 3 as relating to the fulfillment of legal and contractual obligations / rights as well as for purposes 4 to 6 as relating to the execution of activities functional to the contractual relationship and the economic activity of the writer. In relation to these purposes, any refusal to provide data or to authorize its processing may make it impossible for the writer and the interested party to comply with the commitments mutually assumed in the contract and with legal obligations.
With regard to the purposes from 7 to 9, the provision of data and its processing are optional.
With regard to the purpose in point 10 which applies exclusively to technical navigation and use data of our site, these are collected and processed in an aggregate and anonymous manner (therefore do not require consent to use) and their processing is based on the legitimate interest of the owner to make the navigation of the website functional by the user and to verify its correct functioning.

Methods and Data Processors

The processing of data will take place by employees, expressly designated by the writer as data processors, or even by external parties, in compliance with the rules of EU Regulation 2016/679 and the instructions provided by the writer.

Access to databases managed with IT tools is also allowed to any other external parties, where this is necessary in order to ensure the updating and full functionality of the information systems themselves.
The processing will be carried out using paper, computer or telematic tools and supports in compliance with the provisions to guarantee security and confidentiality, as well as among other things the updating and relevance of the data with respect to the purposes stated in the specific paragraphs of this statement.

Safety-Fire does not resell to third parties or deliberately disclose personal data collected directly from data subjects.

Recipients of personal data

In relation to the aforementioned purposes, your personal data may be disclosed to the following categories of subjects:

  1. State, regional, provincial and municipal administrations, Public Security Authorities, Judicial Authorities;
  2. Credit institutions, leasing companies, factoring companies;
  3. Insurance companies;
  4. Agents, distributors, brokers, service centers, contractors and client companies;
  5. Auditing and certification of financial statements, quality certification;
  6. Commercial information and debt collection companies;
  7. Law firms and consulting firms and technical and tax assistance;
  8. Trade organizations;
  9. Universities, schools of all levels or training centers;
  10. Subjects in charge of the elaboration and / or sending of company magazines, information leaflets, invitations to commercial initiatives;
  11. IT services company in the context of assistance activities in the management of corporate information systems.

Data retention period

We will retain your personal data only for the time required to fulfill the purposes for which they were collected, which also include legal, accounting and reporting requirements.
To determine the adequacy of the retention period of personal data, we take into account the amount, nature and sensitivity of the personal data as well as the potential harm that unauthorised use or disclosure of your personal data could cause, the purposes for which we process your personal data, and consider whether we can achieve the same purposes by other means, and applicable legal requirements.
We are required by law to retain a certain amount of basic information about our customers (including Contact, Identity, Financial and Transaction Data) for ten years after the termination of the client relationship, for tax purposes.
In some cases we may anonymise your personal data (so that it can no longer be associated with you) for statistical or research purposes, in which case we may use such information indefinitely, without further communication to you.

Transfer of your personal data abroad

Safety-Fire does not transfer your personal data outside the EU.

Your rights as a "data subject"

In relation to the aforementioned treatments and the related data existing in the archives of the writer, the rights referred to in Articles. 15, 16, 17, 18, 20, 21 of EU Regulation 2016/679 (the text of which is available on the www.garanteprivacy.it website) by written request to the contact persons indicated below in this statement.
Your personal data is protected by rights under data protection laws.

    This allows you to receive a copy of your personal data held by Safety-Fire and verify the lawfulness of the processing.
  • the right to request correction of your personal data.
    This allows you to have any incomplete or incorrect data held by Safety-Fire corrected; this may involve checking the accuracy of the new data provided by you.
  • the right to request the deletion of your personal data.
    This allows you to request the deletion or removal of personal data when there is no longer a valid reason to continue processing it. You also have the right to request the erasure or removal of your personal data if you have validly exercised your right to object to the processing (see next point), if your information has been processed unlawfully by Safety-Fire or if the Company is obliged to erasure under local laws. It should be noted, however, that it will not always be possible to execute your cancellation requests due to specific legal reasons that will be notified to you - if applicable - at the time of your request.
  • the right to object to the processing of your personal data.
    In the event that your personal data is processed for a legitimate reason (by Safety-Fire or a third party) but there is something about your particular situation that makes you want to object to the processing, believing that this may have an impact on your fundamental rights and freedoms, you have the right to object to the processing. You also have the right to object to processing if your personal data is processed by Safety-Fire directly for marketing purposes. In some cases, we may demonstrate compelling grounds for processing your information that override your rights and freedoms.
  • the right to request restrictions on the processing of your personal data.
    This allows you to request us to suspend the processing of your personal data in the following situations:
    • (a) if you wish to establish the accuracy of the data;
    • (b) if the use by us is unlawful but you do not want the data to be erased;
    • (c) if you need Safety-Fire to keep your data despite the fact that this is no longer necessary for the Company but you need to act or defend yourself in court; or
    • (d) you have objected to the use of your data but we need it to establish the existence of legitimate overriding reasons for using it.
  • the right to request the transfer of your personal data.
    Your personal data will be provided to you or to third parties chosen by you in a structured format, readable by commonly used equipment. It should be noted that this right only applies to automated information previously authorized by you or otherwise used in the context of contractual services to you.
  • the right to withdraw your consent.
    In the event that consent is necessary to process your personal data, you have the right to withdraw it. However, this will not affect the lawfulness of any data processing performed previously. Withdrawing your consent may prevent Safety-Fire from providing you with certain products or services. If applicable, you will be informed at the time of withdrawal of consent by you.
  • the right to lodge a complaint with the supervisory authority.
    Without prejudice to your right to appeal in any other administrative or judicial forum, if you believe that the processing of your Personal Data conducted by the Data Controller is in violation of the Regulation and / or applicable legislation, you can lodge a complaint with the competent Authority for the Protection of Personal Data.

Generally there are no charges:
You will not be required to access your personal data (or to exercise other rights). However, you may be charged reasonable costs for manifestly unfounded, repeated or excessive requests. Alternatively, in such cases we may refuse to comply with such requests.

What we may ask you:
We may need to request specific information from you to help us confirm your identity and guarantee you the right to access your personal data (or the exercise of any of your other rights). This is a security measure to prevent personal data from being disclosed to unauthorized parties. We may also contact you to ask for further information about your possible reminders.

Response Timelines:
We try to respond to any admissible request within one month. If your request is particularly complex or if you have submitted a large number of requests, it may take a longer period of time. In this case you will be informed and kept updated.

Data Security

We have implemented appropriate security measures to prevent your personal data from being accidentally lost, manipulated or otherwise used in an unauthorized manner, altered or disclosed. In addition, access to your personal data is limited to employees, agents, suppliers and other third parties with access needs exclusively for work. They will process your personal data according to our instructions and will be subject to a duty of confidentiality.
We have procedures in place to deal with any suspected personal data breach, which will be notified to you and any competent authorities, should we be legally required to do so.
